Section 34 of the Environmental Protection Act 1990 imposes a Duty of Care on businesses to dispose of their waste in a responsible manner.
You must ensure that the person removing your waste is a registered waste carrier, either Council or private company.
You are responsible for ensuring that your waste is disposed of properly and must ask for proof from your waste contractor that they are registered (Fife Council are exempt from registration).
Your waste contractor should issue you with a Waste Description and Transfer Note to complete, and you must retain a copy, by law, for 2 years.
Where regular uplifts occur an annual Waste Description and Transfer Note can be issued.
Breach of Duty of Care is a criminal offence and may result in an unlimited fine.

What is our duty of care?
Duty of care applies to anyone who runs a business and produces stores, transports, recycles, or disposes waste. There is a type of waste that does not matters that is if it is in cardboard boxes, plastic packaging or simply lunch time left over you are responsible of it.
The Environmental Protection Act 1990 (Section 34) introduced the concept of Duty of Care. Under the law on Duty of Care you must take all reasonable steps to keep waste safe. You must package waste in suitable containers so that it cannot fall out, blow away, or escape. Containers should be sufficiently secure so that they cannot be broken open and waste removed by animals, accident or weather.
